Terms and Conditions of use of the digital channel
MACHUPICCHU PERU JOURNEYS, also known as the Company in this document, wants you to enjoy your vacation in Peru to the fullest. For a seamless experience, we recommend carefully reading our terms and conditions and following the instructions of your sales agent.
MACHUPICCHU PERU JOURNEYS is considered one of the safest agencies in Cusco.
Please read the following conditions carefully, as they constitute your contract with MACHUPICCHU PERU JOURNEYS. By booking a trip with MACHUPICCHU PERU JOURNEYS, you agree to be bound by these Terms and Conditions, which describe, among other things, our cancellation policy and certain limitations of liability when making your reservation.
The quotation provided by us will be valid once the reservation is confirmed, from which point you may ask any questions regarding your vacation. MACHUPICCHU PERU JOURNEYS will be delighted to answer all your questions. The quotes do not apply to international flights to and from Peru. If you want our assistance with international flights or domestic flights within Peru, the flight must be paid immediately and purchased on the same day or, if possible, the next day to ensure the validity of the offer, as prices vary from day to day.
Our prices do not include unspecified meals in your itinerary, personal expenses, personal insurance, and baggage handling.
The Contract
The contract is between MACHUPICCHU PERU JOURNEYS (also known as the company) and the client, who is the person traveling or attempting to travel on a tour operated by the company. You, the client, are deemed to have read and understood our travel policy as stated below. By making a reservation by phone, website, email, or fax, you accept and are bound by these Terms and Conditions. These Terms and Conditions constitute the entire agreement between the Company and the Client regarding the subject matter herein and will constitute a binding agreement. There is no verbal or written representation, warranty, warranty agreement, prior agreement, description of services, or conditions or any promise of refund not expressed herein. The service(s) to be provided is/are the tour(s) mentioned in the booking confirmation.
These conditions only apply to the services in our program and not to international and domestic flights. These are subject to the conditions imposed by the airlines.
Securing Your Reservation
To secure the reservation, MACHUPICCHU PERU JOURNEYS requires a completed reservation form (either from our website or sent by us with your quote), along with the necessary deposit payment. The advisable time to make your reservation is 30 days before your trip to Peru. A reservation is accepted and becomes definitive only from the date we receive your deposit, and at that moment, a contract exists. MACHUPICCHU PERU JOURNEYS reserves the right to refuse any reservation at its discretion.
Customer Details
To confirm and guarantee the organization of the trip for clients, the client must provide all their identity details with the initial payment or no later than 30 days before the start of the trip. Customer details include passport number, copy of passport details and medical form (if applicable), full name, date of birth, international flight information, nationality, and contact phone number for emergencies.
Final Payment / Surcharges
In order for the company to confirm and guarantee the organization of the trip for clients, the client must provide all customer details with the final payment at the beginning of the tour.
Surcharges: To avoid surcharges on your vacation, make your reservation in advance and do not change hotels at the last moment.
If You Change Your Reservation
An administration fee of $50 USD per person will be charged if the confirmed reservation is changed or transferred to a different departure date or tour, up to 30 days before your trip. From then on, all changes will be treated as cancellations and subject to charges as follows.
If a client is unable to travel and notifies us about 20 days in advance, under circumstances that MACHUPICCHU PERU JOURNEYS deems reasonable, the reservation may be transferred to another suitable person, or the money will be refunded minus 20%. The 10% covers money transfer fees, and the other 10% covers administrative expenses. Your money will be refunded within 15 days.
Changes
The company reserves the right to modify any of the facilities, services, or prices described in the brochure or website. If such a change is made, the customer will be informed at the time of booking or when the change occurs. While the company will strive to operate all tours as advertised, reasonable changes to the itinerary may be made when deemed necessary or convenient by the Company due to external factors beyond the company’s control.
Cancellation Policy – Right of Withdrawal
Confirmed reservations have a cancellation policy as follows:
- Cancellations or changes to paid reservations have a penalty of 50% of the total package value and must be made within a maximum period of 60 calendar days after receiving the request.
- Cancellations or changes between 8 and 1 day(s) before the departure date have a penalty of 100% of the total package value.
- Airline tickets from commercial airlines or charter flights included in the reservation are non-refundable. In case of cancellation, the flights will remain in the name of the reservation holders, who can use the tickets within a period of 1 year, paying the penalties and fare changes that may apply at the time of use.
Complaints
If the client has a complaint about any of the tour arrangements, it is a condition of the contract that they inform our local representative at that time. If they do not complain at that time and later deny us the opportunity to investigate and rectify the problem, MACHUPICCHU PERU JOURNEYS cannot accept any responsibility. If the client has a dispute with MACHUPICCHU PERU JOURNEYS and cannot resolve it, please write to us within 28 days of your return, and we will continue to investigate.
Travel and Cancellation Insurance
Travel insurance is highly recommended for all clients booking with us. We recommend that it should cover personal injury, medical expenses, repatriation expenses, evacuation expenses, cancellation, and curtailment. It is our policy to check the validity and coverage of your insurance policy, and we reserve the right to deny transportation to anyone whose insurance does not meet these criteria. If you decide not to purchase travel insurance, you will be required to sign a waiver form acknowledging your acceptance that insurance is recommended but declined, and in case of the need for a change or cancellation of your trip or if you incur expenses such as medical expenses, the client will be responsible for all additional costs incurred.
Medical Form
For insurance purposes, all clients are required to complete our MACHUPICCHU PERU JOURNEYS medical form, which must be signed and dated by a practicing physician (if there are pre-existing conditions) and sent to us no later than 15 days before the start of your trip.
Financial Security
MACHUPICCHU PERU JOURNEYS is an accredited travel agency by the Ministry of Tourism and registered as a public limited company with the Peruvian tourism office ministries. MACHUPICCHU PERU JOURNEYS complies with current European standards regarding the protection of client money.
Client Responsibilities
The client agrees to accept the authority and decisions of MACHUPICCHU PERU JOURNEYS employees, tour leaders, and agents while on their vacation. If, in the opinion of these individuals, a client’s health or behavior at any time, before or after departure, seems to endanger the progress, safety, comfort, or tranquility of the tour, the client may be excluded from all or part of the tour.
Clients must possess their respective identification documents and are responsible for carrying a valid visa passport, if applicable, and the required vaccination certificates for their entire trip. Your passport must be valid for 6 months after the return date.
Our Responsibilities
Reservations are accepted on the understanding that clients appreciate the possible risks inherent in adventure travel and that they undertake the visits, excursions, or expeditions outlined in our programs at their own will. It is also important to understand that even the most meticulous arrangements can go wrong.
The company is obliged to provide its services with the necessary diligence to ensure that the entire trip goes smoothly, and we will strive to serve you to the best of our ability.
The Company assumes no responsibility for force majeure, weather phenomena, or natural phenomena that may occur before or during the trip, or for any eventuality that may make any travel uncomfortable or difficult, or for any delay or obstruction of your trip in any way. The Company does not guarantee the failure, whether partial or total, of the provision of services that the Company has undertaken to provide, which may have been affected by the aforementioned factors.
Flights / Delays
We cannot accept any responsibility for cancellations or delays in any of your flights if the cancellation or delay is due to adverse weather conditions, rescheduling by the airline, airport authority, and/or action by air traffic controllers, mechanical failures, or industrial action.
Our company will strive to solve your travel itinerary, ensuring that any inconvenience is resolved and nothing is affected by air delays.
The Client must understand and be flexible if the problems cannot be solved due to air delays.
Children Policy
In all programs, unless otherwise stated, the maximum age for a child is 11 years and 11 months. Individuals aged 12 years and older are considered adults and will be subject to adult rates.
Last-Minute Reservations
For all reservations made within 10 days of departure, there will be a USD $50.00 fee charged to the file. This Last-Minute fee covers our additional costs for Hotel providers, Train Tickets, Bus Tickets, and operational expenses.
By signing this, I declare that I have read and understood the aforementioned Terms and Conditions , as well as the sales conditions as indicated by the company on the website/brochure or provided form, and I am fully aware that my signature confirms this declaration.
